Three Disasters, Three Completely Different Call Patterns
North Carolina gets hurricanes on the coast, and it also gets what those same storms do several hundred miles inland — Helene made that impossible to argue with, flooding mountain counties, cutting roads and taking out power in places that had never planned for a tropical system. Calling Into North Carolina: Article 4 and the Charitable Licensing Layer
Federal law is the floor for any outbound program calling North Carolina consumers — the Telephone Consumer Protection Act and the national Do Not Call registry — and Chapter 75, Article 4 of the General Statutes builds the state's own regime on top of it. What makes Article 4 distinctive is that it is written around process rather than only around outcomes: telephone solicitors are expected to maintain systems, written procedures and internal do-not-call records, and to train, monitor and enforce compliance among their own employees and their independent contractors. Enforcement runs through the North Carolina Attorney General's Consumer Protection Division. Separately, if any part of the calling is charitable fundraising, the Secretary of State's Charitable Solicitation Licensing Division licenses professional solicitors and fundraising consultants and requires their contracts to be filed, with exemptions that turn on the organization and the arrangement.
The operational reading is that in North Carolina the written procedure is itself part of the obligation.
